These Terms of Service (“Terms”) comprise a legally binding agreement between Cyber Garage Doors (“Cyber Garage Doors,” “we,” “us,” or “our”) and any individual or entity that visits our website, requests an estimate, schedules a service appointment, or otherwise uses our services (“you” or “Customer”). By accessing the Cyber Garage Doors website or engaging us for garage door repair, installation, maintenance, consultation, or emergency services (collectively, the “Services”), you agree to these Terms. If you do not agree, you must not use our Services.

1. Scope Of Services

Cyber Garage Doors provides residential and light commercial garage door diagnostics, repairs, replacements, installations, opener upgrades, tune-ups, and emergency response throughout Northern & Central New Jersey. All Services are delivered by licensed and insured technicians or approved subcontractors operating under our supervision.

2. Website & Informational Content

Information on cybergaragedoors.com, associated blogs, guides, or downloadable resources is provided for general educational purposes. We strive for accuracy but do not guarantee completeness or suitability for every situation. Always consult a qualified technician before attempting repairs. Use of the website is at your own risk.

3. Estimates, Pricing & Authorization

  • Estimates: We provide written or digital estimates before starting work. Estimates are valid for 30 days unless otherwise stated and may change if site conditions differ from those described when scheduled.
  • Authorization: By approving an estimate verbally, digitally, or in writing, you authorize Cyber Garage Doors to perform the described Services and to charge agreed-upon fees.
  • Trip fees & minimums: An onsite diagnostic fee may apply when a technician is dispatched and no repair is performed. Emergency, after-hours, or holiday calls may include surcharges disclosed before dispatch.
  • Change orders: If additional work is required, we will request approval and update pricing before proceeding.

4. Scheduling, Arrival Windows & Cancellations

  • Appointments are scheduled in arrival windows. Traffic, weather, supply availability, or emergency responses may affect schedule commitments. We will communicate updates as soon as practicable.
  • Please provide safe access to the service location, including gate codes, parking instructions, elevator reservations, or building entry approvals.
  • You may cancel or reschedule with no fee by providing at least 2 hours’ notice during normal business hours. Missed appointments or cancellations with insufficient notice may incur a cancellation fee to cover technician travel time.

5. Customer Responsibilities

  • Ensure someone 18 years or older is on site to approve work, answer questions, and provide payment upon completion.
  • Secure pets, clear workspace around the garage door and opener, and remove vehicles when possible.
  • Inform technicians of any known hazards, unusual wiring, previous DIY repairs, or structural concerns.
  • Review post-service recommendations and follow safety instructions. Cyber Garage Doors is not responsible for damages resulting from your failure to act on recommended repairs or safety warnings.

6. Payments

  • Payment is due at the time Services are rendered unless otherwise specified in a written agreement.
  • We accept major credit cards, debit cards, approved financing, checks, and certain digital wallets. Returned checks will include a processing fee allowed by New Jersey law.
  • Past-due accounts may incur late fees, collection costs, and interest at the maximum rate permitted by law.
  • Ownership of installed parts, doors, or openers may remain with Cyber Garage Doors until invoices are paid in full.

7. Warranties & Guarantees

  • Workmanship: We warrant labor for 12 months unless otherwise stated on the invoice. Some services (e.g., temporary repairs, emergency securing) may carry shorter warranties.
  • Materials: Manufacturer warranties apply to parts, doors, and openers. We will register products when possible and assist with claims, but final decisions rest with the manufacturer.
  • Exclusions: Warranties do not cover damage due to misuse, neglect, accidents, weather events, tampering, or work performed by others after our service.
  • Remedies: Your exclusive remedy for breach of warranty is repair, re-performance, or refund of the affected service at our discretion.

8. Disclaimers

Except for express warranties in these Terms or your invoice, the Services and website are provided “as is” without additional warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Some jurisdictions do not allow disclaiming implied warranties, so the above exclusion may not apply to you.

9. Limitation Of Liability

To the fullest extent permitted by law, Cyber Garage Doors and its owners, employees, subcontractors, and affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if advised of the possibility. Our total liability for any claim related to the Services will not exceed the amount you paid for the specific Service giving rise to the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless Cyber Garage Doors and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, misuse of the Services, violation of law, or negligence, except to the extent caused by our gross negligence or willful misconduct.

You may not reproduce, distribute, or create derivative works without our prior written consent.

12. User Submissions & Reviews

By submitting reviews, testimonials, photos, or feedback, you grant Cyber Garage Doors a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content in any media for marketing or service improvement, subject to our Privacy Policy. We reserve the right to moderate or remove submissions that are defamatory, unlawful, or unrelated to our Services.

13. Third-Party Services

Our website may reference third-party products, financing partners, or manufacturers. We are not responsible for their terms, policies, or performance. Your dealings with third parties are solely between you and the applicable provider.

14. Force Majeure

Cyber Garage Doors is not liable for delays or failures to perform resulting from events beyond our reasonable control, including severe weather, natural disasters, pandemics, supply chain disruptions, labor shortages, or government actions.

15. Governing Law & Venue

These Terms are governed by the laws of the State of New Jersey without regard to conflict of laws principles. Any dispute arising out of the Services or these Terms shall be resolved in the state or federal courts located in Essex County, New Jersey, unless both parties agree to alternative dispute resolution or arbitration. You consent to personal jurisdiction in those courts.

16. Dispute Resolution & Claims

Before filing a lawsuit, the parties agree to attempt to resolve disputes in good faith through direct negotiation. If the dispute remains unresolved after 30 days, either party may pursue remedies in court. Small claims court actions may be filed without prior negotiation.

17. Changes To These Terms

We may modify these Terms at any time to reflect operational changes, legal requirements, or service updates. Revised Terms become effective when posted to our website. Your continued use of the website or Services after changes take effect constitutes acceptance of the updated Terms.
